Neighbor files suit over dog barking

Tom and Joe McDaniel hired a lawyer and filed a lawsuit. The brothers have sued Dan Ullman, claiming the relentless yapping of his dogs has created anxiety and compromised their standard of living. They are seeking more than $25,000 in damages.... Ullman, an Akron police officer, owns at least two dogs, including a pit bull. The back yard of his Tampa Avenue home is fenced. But the McDaniels claim that since August 2005, they have been unable to get Ullman to control his dogs. Misdemeanor charges were filed in Akron Municipal Court against Ullman in 2006 but ultimately dismissed. Other charges filed against Ullman in 2000 and 2001 when he lived elsewhere, including failure to control or confine a dog, were also dismissed, according to court records. It is unusual for a barking-dog issue to go to trial because of the cost of hiring an attorney, said J. Dean Carro, a law professor at the University of Akron.
